ForestSource Identify™ – Terms of Service

1. Eligibility & Accounts

• You must be at least 18 years old and able to form a binding contract to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Service Description

ForestSource Identify™ uses AI models to generate best-effort species identification from images of wood provided by you. Results are estimates only and may be incomplete, inaccurate, or misleading.

The Service may change over time. We may update, suspend, or discontinue the Service (or any part of it) at our discretion.

3. No Professional or Safety-Critical Advice

The Service does not provide professional engineering, structural, safety, or legal advice.

You agree not to rely solely on the Service for:

• Structural, life-safety, or code-related decisions
• Applications where an incorrect species could cause damage, injury, or regulatory violations

You are solely responsible for independently verifying any results before using them in critical applications.

4. Your Content

"Content" means any images, text, or other data you upload or provide to the Service.

By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and use your Content for the purpose of:

• Providing the Service to you
• Operating, maintaining, and improving our models and systems
• Analyzing usage in aggregate (for example, counts of identifications per species)

You represent that you have the rights to upload and use the Content and that it does not violate any laws or third-party rights.

5. Data Storage & Retention

We store uploaded images, prediction results, and usage logs (such as timestamps, model outputs, and your account details) as part of normal Service operation. See our Privacy Policy for more about how we handle personal data.

We are not obligated to retain your Content forever and may remove it as part of routine cleanup, security, or maintenance.

6. Plans, Billing, and Taxes

If you sign up for a paid plan (such as ForestSource Identify™ Pro), you agree to:

• Pay the fees associated with your selected plan
• Allow recurring charges via our payment processor (Stripe)

Plan limits (e.g., number of monthly identifications) are enforced at our discretion. We may change pricing and plan details in the future; any changes to your current subscription will be communicated in advance where reasonable.

All fees are exclusive of any taxes, which are your responsibility unless required otherwise by law.

7. Acceptable Use

You agree not to:

• Attempt to circumvent usage limits, rate limits, or billing
• Probe, scan, or test the vulnerability of the Service
• Use the Service to build or train competing models or services without our express permission
• Use the Service in any way that violates applicable law

We may suspend or terminate your access if we reasonably believe you are violating these Terms or harming the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose, or non-infringement.

We do not guarantee that results will be correct, complete, or suitable for any specific use case.

9. Limitation of Liability

To the maximum extent permitted by law, ForestSource and its owners, employees, and partners will not be liable for:

• Any indirect, incidental, consequential, or punitive damages
• Any loss of profits, revenue, or data
• Any damages arising from your reliance on the Service's outputs

In all cases, our total liability arising out of or relating to the Service will not exceed the amount you have paid for the Service in the three (3) months prior to the event giving rise to the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if:

• You violate these Terms
• We discontinue the Service
• Payment for a paid plan fails after a reasonable grace period

Upon termination, some information (such as logs and billing records) may be retained as required for legal, accounting, or operational purposes.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Service after changes become effective means you accept the revised Terms.
